2. Restrictive Covenants & Rights of Way
Presented by David Keighley.
Advising on Restrictive Covenants and the potential limits on easements such as Rights of Way is often not clear cut. This session will look at some practical issues to consider including:
- Abandonment of Restrictive Covenant
- Intensification and/or extending the scope of an easement of Easements
- Encroachment on Rights of Way
- Limits on a Right of Way for domestic property
3. Newbuild Conveyancing: Tips and Traps
Presented by Richard Snape.
The course will look at some of the many issues relating to newbuild conveyancing, primarily for the buyer and some other problems which may arise together with their solutions.
Topics covered include:
- NHBC and similar schemes including the future of newbuild guarantees under the Building Safety Act 2022
- Planning issues including S.106 agreements, planning conditions and Community Infrastructure Levy
- Drainage issues
- S.38 Highways Agreements
- Enforceability of positive covenants in freehold land
4. Conveyancing and the Family Home
Presented by Richard Snape.
Conveyancing and the family home involves many difficulties. This course aims to highlight the difficulties and their solutions. The course is useful for both conveyancers and family practitioners.
Topics covered include:
- The various declarations of trust available
- Gifts from parents to children
- Potential undue influence and conflicts of interest between the parties
- Overriding interests and consent forms
- Problems in relation to severance
