A revised Model Lease has been introduced for use in the grant of new Shared Ownership Leases. This lease will come into widespread use during 2023. The changes introduced to the model lease are significant.

2. Building Safety Act 2022: Leaseholder Protection & Lenders Requirements

The course will look at some of the issues relating to the enforceability of restrictive covenants in freehold land.

  • Discharge of covenants post Alexander Devine v Housing Solutions (2020)
  • Enforceability of restrictive covenants against third parties
  • The importance of restrictive covenants after the planning use class changes in England 2020-21
  • Tips as to how to render restrictive covenants unenforceable
