An update on developments in conveyancing including summaries of case law, decisions of tribunals, and statutory provisions

‘An update on developments in conveyancing including summaries of case law, decisions of tribunals, and statutory provisions’ is a FREE interactive E-Publication brought to you by the SOLICITORS group.

About the Publication

The Property Book (An Update on developments in conveyancing) covers a range of issues that have arisen in recent cases, such as

  • Where a series of repairs have been or are to be carried out by a ‘residential’ landlord, which approach should be used to ascertain whether the £250 threshold has been reached thus triggering the need for the landlord to consult about proposed major works?
  • The scope of an express right of way.
  • Abandonment and partial abandonment of a right of way.
  • Whether the purchaser of a building plot had the benefit of an implied easement to connect the plot to the mains utility services across the retained land and to maintain those connections.
  • Whether the “Bowerman” duty (the duty on a solicitor to report to his lender client matters relevant to the valuation of the property offered as security for a loan) had been ousted by the terms of the CML Lenders Handbook.
  • Whether an architect’s certificate could found the basis of a claim for negligent misstatement or collateral warranty.
  • The extent of a mortgagee in possession’s legal duties as an involuntary bailee of chattels that have been left behind by the borrower on execution of a warrant for possession.
  • The recoverability of service charges under the provisions of residential leases.
  • The liability of a conveyancer for breach of trust in an action brought by mortgage lender.

“The event was well put together and executed, and the traffic of potential customers for us was high. We had a number of enquiries regarding our services after the event and we feel our attendance there was important to our overall brand exposure. We feel a Law event of this size without Euromoney Legal Training present could potentially be hurtful to us as a business. We would recommend you to attend and shall ourselves be there again in 2008.”
